The only defended ease was that in which Humphrey and Son sued T. .Lilian for £5 5/8 for meat supplied to defendant's house and camp. Mr 11. Weston appeared for plaintiff, !ind Mr !■'. E. Wilson for defendant. Ileury Humphrey, who was fonueriy a butcher at Okato, swore that ihe meat iiad been supplied by his son, a partner, who made the entries in the ledger produced. Had rendered the house account to defendant's assignee, but his wife disputed thai, t\„ e»mp aecouut, Julila had told him, would lie settled by one of his mates, but no settlement had been obtained. Mr \Y ilson applied for a nonsuit, on the ground that tiie son should have appeared as piainlill'. Mr AVeslon submitted that a prima facie ease had been made out, which the defendant should answer.

The Magistrate said he thought, he would have to decide against the. delendant. There was 110 evidence of tho delivery or receipt of the goods for which payment was claimed. The defendant, in tile box, stated that lie had stopped the "running'' account between the house, and tiie piainlill', and the goods claimed for had been paid for, cash at the cart. With re-

gard to the camp, the account was not his. There were six mates, working: on day work, and each should have paid his share. The goods had been, delivered, for piaintiir for j amount claimed. .Co 5/8, and £2 o/Gi costs.
