At Balclutha to-day, before Mr Cruikshank, S.M., charges against George Franois Greenwood and George Fislierj of having between certain date: kept alcoholic liquor for salo in a pro lubition district were dismissed Trillion prejudice, on the contention o£ counso for the defence that although the sah of liquor outside the district to defend, ants was proyed, there was no evidenci to prove it went into or was kept in the prohibition district. William Marshall was convicted of keeping liquor for sale in a no-license district, and was sentenced (o three months imprisonment without hard labour. Counsel for the defence raised the point that (here was no proof of t-ic liquor being in a ao-lieense district, and asked for an adjournment lo hare the po!nt settled. He declined to put his client into the witness box, as Hint wouhtdestroy his law point. The Magistrate said the onus was on tho accusod, and if he did not take the oppjrt unity he would be convicted, Sentence was stayed for seven days to allow of appeal being proceeded with. Michael Liston on a similar charge, was finod £SO and costs, execution i being stayed pending appeal on the same grounds as in the previous case. |
