Ormoud sued the Railway Department for £23 '.ls, value, of a bag anil contents lost on the railway between Lyllollon and Christchurch. To-day the Magistrate gave judgment against Mr Ormoud, on (he ground that by provision made under the Kaihvay Act, the Government was not responsible for passengers' luggage unless it was cheeked. Plaintiff had not chocked his luggage, and therefore could not recover.
