THE PEA-RIFLE NUISANCE.

Judgment whs given in the Te Puke pen-rifle sliooliug case in which Mr Reed, for defendant, moved that claimint be non-suited, while Mr Earl moved that judgment be given for plaintiff. The claim was one in which i native named Kawuua Karaku sued Timothy Kenealy for LSOO damages through injury caused by n pea-rifle, lireil by defendant's son. His Honor said in the statement of claim the ease of action alleged, that on the Ist,lt July, l!)ii;j, at Te I'uke, plaiutilV, while playing, or about lo play football, was struck by n bullet from a pea-rifle discharged by Donald Konealy, son of defendant, whereby plaintiff was dangerously wounded; that defendant had been warned by certain of his neighbours of the danger of permitting his son to have control of a pen-rifle, and that defendant was aware that a bullet fired from the weapon by his son, had passed through the window of a shop to the danger of the inmates, and further that defendant's son, at, the time of the shooting, was using the pea-rifle with the knowledge and sanction of defendant, and by reason of the defendant's negligence. The defence was a denial of the material allegations in the statements of claim. A verdict was returned by the jury for LSOO damageß. After reviewing the evidence very exhaustively, His Honor upheld the fuli claim for LSOO, with costs according to scale.
