At tho civil sitting of the S.M. Court on Friday, before Mr T. Hutchison, S.M., Judgment by default was entered in the following undefended cases | Herbert J. Cornwall v. Hobertina M. The New Plymouth Harbour Board, represented by Mr Quilliam, took proceedings against a good number of persons for outstanding rates. In many cases the summonses hod not been served, and in others the hearing was adjourned, The majority confessed judgment or paid the amount into Court. In the caso of Henry Foster, a claim for £2 8s 2d, judgment was reserved to June 9.

I Tho S.M. ga,ve his reserved decision in tho cluiiw mado by the New Plymouth Borough Council against 'Peters, tenant of a borough reserve at Toko, for £1 19s lid, baljance of rent. The claim was defended on tho grounds that defendant's rent should be reduced in consequence of a portion of the land which he held under lease being taken under tho Public Works Act for the purpose of building the Toko railway. The Council was compensated for tho land taken, a compromise having been arrived at, and the town clerk, on his own initiation, deeming it equitable, allowed Peters a proportionate reduct ion in the ivn't for two •or thrco years, the Council this year resolving to suo for the recovery of balances. The S.M. ruled that the Council had waved its 'jght to recover, and found for the defendant, with £1 Is costs. Mr Malonc represented the defendant and Mr Quilliam the Council.
