CONTESTING A WILL.
(Per Tress Association.) AUCKLAND, May 11. At the Supremo Court, before Mr Justice Edwards, a special sitting was held to hear the case of Donjby v. Donhy and othersi, an action to propound a will. The action involves discussion of the whole of the provisions of the Wills Act, inasmuch as the document produced in Court has the signature of the testator as well as the signatures of two witnesses. Dpfeud'iuit datum the will to ibc invalid, and that an intestacy must be declarad, 'the grounds for .such contention being an allegation that careful inquiry has ,failed to aocount for tho existence of the portions whose names are allixed as witnesses to his will. Seven witnesses, including the pluintifP, who admitted that his father had inaide a previous will that could not fas found, were examined, four lor plain- 1 tiff and three for defence. After this «jueslions> of law wore argued at length, and the Court reserved its decision.
