—Judgment Summons.— T. 0. Kelsey v. Edward Cook. Mr Quilliam, for plaintiff, applied for an order in respect of £ll Bs, interest on mortgage. It appeared from the evidence that the plaintiff was second mortgagee who had paid the interest on the first mortgage, and that defendant hud not paid interest on either of the mortgages. Defendant had promised to pay the interest out of proceeds of sale of a team of bullocks', but the only explanation defendant >g'avc plaintiff as to what hadj become of tho proceeds was that he (defendant) had bought clothes. Plaintiff offered to forego the arrears if defendant would execute a transfer. This defendant agreed to, and the case was adjourned for a week to enable the arrangement to be carried out, the S.M. intimating that as matters 'stood); at present he was inclined to make an order.
