His Honor Mr Justice Edwards.) —Charge of Kape.— Oeorgo Thomas Iliitton and Henry Avenell, two young men, were put on their trial for a third time, Button on a charge of rnping Annie lllope Uoyd on the Tawhiti Koad, i near Ilnwern. on March iilird last, 'and Avenell wilh assisting Hutton I in the commission of the offence. The following jury was empanelled :—T. furlong, inn. (foreman), It. S. Longstaff, T. Parkin, 11. Wells, I'. iMndscn, W. It. Ilasell, 11. 1-line, T. Oatchpule. A, A, 11 ace, (1. M. Ar-row-smith, .1. Looney, and .1. K. 1-epine. 'J'he frown ordered seven jurors to stand aside, and counsel for accused challenged a similar nuinher. Mr Kerr (Staudish and Kerr) prosecuted ; Mr H. 11. Welsh appeared for llutton, and .Mr Claude 11. Weston (Weston and West on) appeared for Avenell. Evidence was given as in the former trials, with the addition of two police witnesses, Ada and James• Power, who stated that, they heard screams from the direction of (lie. spot where the offence was alleged to have been committed, on the night in question. The jury retired shortly ufter live o'clock, and returned before eight wilh a verdict of guilty. His Honour, in sentencing/the pristheir conduct. He had been influenced by the character of the woman concerned in the case, otherwise the prisoners would have gone to gaol young men and come out in middle age. As it was, they would be sentenced to three years' hard labour.
