A Charge Dismissed.
(Per Press Association). . HOKITIKA, May 81. John Watson Scully, formerly a hotelkeeper in Wostport but now a restaurant-keeper in Wellington, was hanged on remand at the S.M. Court to-day with supplying an instrument to Miss Amelia Edgo for the purpose of procuring an abortion in June of lust year. Before proeccdng with the case the Magistrate sai«l it was not usual to have a cueo 'H'ai-d at Hokitika while the alleged offence took place at Wostport, 100 miles away, and unless the Ciwn understood this and was prepari.-d to i>ay the expenses of any witnesses uccusnd might wish to call lie would' refuse to hoar the case. After some iitcusb'lon counsel for the nccuted ■lected to proceed, and evidence for l lie prosecution was called. The lourt dismissed the information on i lie ground that the ovidence did not liscloso that accused supplied or attempted to supply the instrument. It might bo mentioned that accusal was tried at the September sitting of the Supremo Court for the lame offence, but under a different -ration of tho Criminal Code. The ury found a verdict of guilty, but aw points were raisi-d and subscuu<ntly the Appeal Court quashed tho •onviction.
