Search Warrants.
(Per Press Association.) DUNEDIN, Dec. 7. In the Supreme Court, in banco a motion was heard to quash a search ,-warrant granted on June 15 by 'John McFarlane, a Justice of the Peace, whereby Jotm Oowan, a constable, of Tap&kii|i, was authorised .to enter the dwelling house of Josf eph O'Dowd and seize certain liquor. It was contended -that a Justice of PeacQ had not jurisdiction to grant a warrant. Mr Justice Williams said he did not think the issue of a search warrant was hearing or determination of a prosecution. It was a preliminary matter for -the purpose of keeping the* ■matter in status quo, pending a hearing. That being so he said there was no reason why a warrant should not be issued by a Justice of Peace. The motion was dismissed with costs.
