A Licensing Appeal.
INVERCARGILL, Dec. 3. Mr Justice Williams to-day reserved his decision in an appeal case, Du|lton. of the Empire Hotel, ac(ainst the judgment of Mr McCarthy/S.M., who fined him for giving a'country visitor a hottlo of whiskey at midnight and endorsed his license. Appellant's counnscl urged that it was not a sale, which was a transaction clearly deiinc-d by law, and must be proved to the hilt. Dalton wanted to retire for the night, and told his wife to give his visitor the whiskey and stop his importunities. The Crown counsel urged that the gift was not l>ona fide, and therefore was in the nature of a sale, as appellant looked for future compensation for the gift.
