A DIVORCE) CASE. PER tress association. Wellington, March 20. The Appeal Court ie( now occupied I hearing a Christchiifch case, Hall v.l Hall and another. The appellant ie tie I proprietoi of the Turkish Baths in Christchurch, and sought a divorce from his wife on the grounds of adultery. Mr Justice Denniston found the case proved and a decree was granted. Subsequently evidence was heard on a counter charge of adultery against the husband. The Judge found this also proved, and also granted a decree in this case. The present appeal is by the husband against the finding of adultery against himself. The appeal is brought on two grounds, one of fact and one of law ; first, that the evidenee did not support thehusband'B adultery, secondly that the charge of adultery being proved against the wife, appellant was entitled to a divorce. The Chief Justice announced that the Court considered there was not sufficient evidence to warrant the Court below in finding that Hall had been guilty of adultery. Argument then bfgan on the cross appeal which was instituted on Mrs. Hall's behalf, bu*i this was dismissed. The result is that the decree for dissolution of marriage obtained by the husband stands.
