BOROUGH COUNCIL.
The Borough Council met; on Monday evening. Present: His Worship tbe Mayor (Mr. E. Dockrill), Crs. Lealand Clow, B»llringfir, Brooking, A very, Cattlay, Sfcohr. A tatter from the Railway Depart--j meat was read in reply to the following requirements of the Council: - (v) An | to continuing Moleiworth street acress thy Huatoki to inter sou*; Brmighams'reet: (b) to place the south f <-ont of the now srood'-shed in a 'in') wi<-h the* side of the continuation of Moleswoitb-street; (c) to make a roid for vehicular traffic to tbe beach from Gover-strcet; (d) that overhridges for : foot passengers bo e'reetod at the end of Queen, Brougham, and Liardet-' sfcroets; (e) that the Council have the right to erncb septic tanks rear Iha mouth of the Hiv-toki; (f) protesting aqainst Regirn place being taken by the Department without an equivalent ptreeti; (g) that Bulkeley Terrace be made a chain wide.
The Departments reply was ti the sollowing effect: —As to "a" and "b," if tuo Council were prepared to pay the cost (.£4000) of reclaiming suifigisnt land for the extension of Molonwo'tVistreet, across tho Huitoki without curtailing the amount proposed to bo taken for station purposes the work could he done. Toe Mayor, in seconding tho motion, 'aid is was essential the Council shou.d do I heir utm ;st to protect, and preserve the interests of the ratepayers. Tbe motion was carried. A letter from th* Charitable Aid Board was read regretting Co. Bolll'ingei's resi aviation and stating th.it Or. Stohr had been appointed to fill the :vacancy. The Mayor explained that it devolved on the Board to fi'l temporary vacancies.
The Town Olerk reported that the report of the Waterworks Engineer arrived too lata for consideration by the Works Cam.nitfce:'. On the motion of Or. Bellringer, seconded by the Mayor, it was decided that a letter ba sent to the Engineer drawing his attention to the pravioua resolution of the Council requiring his monthly report to bo s<®t to the Town Olerk in time for consideration by the Works Committee. Mr. E. M. Smith applied for leave of absence to enable him to go to Wellington on a matter of importance to the town, Pome discussion ensued aa to the duration of leave of abs mce. The Mayor stated that he under stood Mr. Smith's visit to Wellington was to' sap Mr. Cadman relative to floating the ironsan3 which seemed now to he on a better financial bass than it ever was befo'e. He thought if Mr. Smith's deputy was doing tho work satisfactorily the Council might agree to the request and he meved in that direction.
Or. Bellringer said that as a matter of principle he should not vote for the motion unless a definite time was stated. After Rome further discussion it was decided that 10 days leavo of absence be granted the Turncock provided the duties are performed by Mr. J. Smith. The Sanitary Inspector reported that the town was ole&ner than when last reported on. The report was receivfd Mr. Courtney attended, and drew the attention of the Council to the beach oni of Buller-street. naent be notified that the Council intend in future charging for their extraordinary supply by meter, and that, the charge will bo the same as at Wansanui, viz., one shilling per thousand aallons; that Messrs Hopkins and Smith's application re signboard be fronted ; that the tender of Messrs D, Berry and Co. for water pipes, etc., delivered duty paid at the New Plymouth j railway station and accompanied by the proper tost certificate, be accepted. Thirty-five tons of pipes at .£9 12s 6J per ton and fittings t>s per schedule in tender , That Mr J. B. Gas Company ba requested to remove the lamp near the Henui bridge on to a more suitable rite upon the bridge, the shadows at present making the bridge dangerous at night. Tendeia were opened for forming and metalling Govar-gtree? (Council providing metal: —H. B.iyly and G. Handricksen, six hundred and eighty I pounds sterling (£680); Kyngdon andj Berridge, five hundred and fifty pound sterling (£550); that the Council bo recommended to accept the tender of Kyngdon and Berridge; (2) that after crrefnlly consideriug the letter from the Board of Education, tho committee cannot see ita way to alter the decision formerly arrived at in reference to charging for water supplied te the the schools.
Cr. BrookiDg moved the adoption of the report. . Mr. 801 l l inger seconded the motion, and, after some discussion, the report was adopted. The Finance Committee reported : That the Chairman consult the' Borough Solicitor re arrnging a meeting witti the Di ectors of the New Plymouth Gas Company on the matter of the purchase of the Gas Works. A dis cussion took place on loan matters, and the Town Clerk was instructed to obtain certiin information. Cr. Bel ringer, in moving the adoption of the report, stated that the prospects of raising the loan from a certain source wm-e not so hopeful as they wero owing to the existence of the harbour rate. The Commits , howover, were still makirg enquiries in othor directions. The report was Tarried. Cr. Catt,ley, in moving the adoption of the repart, said that Dr. Mason informed him that the Council stood in exactly the same position as before the Act wjs passed. As, howeuer, authorities differed on the point, Dr. Mason had promised to obtain the opinion of the highest legal authority in New Za.ilund and is-Eue a circular embadyi 1 . g the result. Cr. Bellringer would not oppose tho adoption of the report, but ho pointed out the Committee were asking for a similar authority of appointment that was refused the Works Committee at the last Council meeting. As to the Council's [osiaoa an a health authority, he contended the matter would not bo nettled until it was argued in the Supreme Court. The Council should know its position in the event of an outbreak of any kind at any time, mid he considered that the Borough solicitor's definite advico on ♦he point should be obtained. The Msyor explained that the Town Clerk had interviewed the solicitor, and the Chairman ef tho Health Committee had interviews' Dr. Ma«on, whose opinion wi-r oppes-d to that of tho Borough solicitor. Cr. Bollringor: Dr. Mason's opinion is not law.
