Thursday, September 6th.— Before Mr. K. L. Stanford, S.M. BREACH OF OOSIEAOI, Morrison v. Mrs. Clarke.—ln delivering judgment in this .case, which was heard on Monday last:, His ,Worship said the insertion of the word "thereabouts" proved that the plaintiff did not adhere to a particular date. On the evidence adduced he thought Morrison had fairly and properly fulfilled his contract, and that Mrs. Clarke resoinded the contract owing.partly to disappointment in the supply of butter and partly owing to potatoes having receded in pries. He, therefore, thought the plaintiff had a good claim for damages, and gave judgment for .£5. —Mr Weston, who appeared for defendant, protested against the value placed by the Magistrate on the potatoes.—Mr Kerr represented the plaintiff. r
