For a similar offence at the Lear Street crossing at Stratford, W. A. Mackay was ordered to pay costs 10s. Defendant said the night was a very bad one and the train was backing in about 10.20. At the particular lime there was about three feet of grass alongside the line but it had since been cut. On the east side of the line there was a strong light and visibility was very bad. Sergeant Anniss explained that defendant ran into trucks, the van having already gone over the crossing. "It is a very different case from the last one,” said the Magistrate, in convicting defendant and ordering him to pay costs IDs.
