During the test she put her fingers to her ears stating: “I don’t understand Italian.” She made no ait enipt to write. Legal action was immediately taken to test the Commonwealth powers to debar her entry. Mr Justice Eva'tt said the legislature had not given the court any authority to inquire when her anyone was a fit and proper person to land in Australia and' the court had no authority to set aside the decision of the Minister, even if it were wrong and unjust. The question was whether the woman had failed to pass a dictation test. Mrs Freer returned to New Zealand by the; Awatea. She was detained on the ship by detectives until it hud cleared Sydney Heads.
