G. Ridings v. C. Palmer.—The defendant had received from Plaintiff in September, 1854, 17 bushels of seed oats, for which an increased quantity 'was to be returned; the plaintiff sought to recover three times the original quantity, as being the understanding at' the" time ofthe transaction.

The defendant contended that the quantity was only to be doubled, aud swore to having delivered 34 bushels'on the 23rd. May 1855, at the store of Mr. G. Ridings. The plaintiff, owing to the difficulty, of procuring the evidence of other persons bearing upon a transaction so long since, then agreed to withdraw the summons. •■•■-

W. Hale v. E. Pritchard.—The plaintiff, W. Hale, nurseryman, of Waimea-road, summoned defendant for the value of 6 dozen gum-trees at 7s. per dozen less a credit of 125., leaving a balance of 30s.

The defendant pleaded they wore not according to order, he had sent for them from;Mr. Hale's own plantation, and had.orderedimd, planted them with the impression that they .were "Nelson plants; he had also been led to believe so from the words of the plaintiff; subsequently it" was admitted that they came from New Plymouth ;< not one of the plants had grown, and he contended the payment because he thought it was a case, that should be brought before the public, as he considered he had been deceived in the purchase. Judgment for plaintiff for 15s.—-<?osts 15s.
