Moses vGoi'rcaiAN.r-Jt appeared that about six weeks :ago: tho. -defendant went to plaintiff while the latter was engaged in the neighbourhood of Richmond selling growing crops and cattle, and desired to know Whether he (plaintiff) would sell a horse for ■ defendant, for which .£±6 was the sum required. The horse, however, was not then sold. Some,little time after plaintiff met defendant in Nelson, and inquired whether he had effected a. sale, aud was told in reply that defendant thought he knew of a purchaser at Richmond for .£4O. Plaintiff then told defendant that he could get a cash purchaser in town for £38, and for that sum the horse in question was eventually sold by Mr. Aiken to Mr.
Young.. v ... v . • For the defence it was swoni that nothing whatever was said about the sale of the horse to Mr. Aiken, nor had anything been said about commission ; but when plaintiff-asked about the sale of the horse in the street, defendant replied that it was partly sold to Mr. Young. A letter from Mr. Young to Mr. Aiken was here put in, which simply went to prove that the latter was the only person through whom the sale of the horse was effected ; and 9 , The Bench considering such documentary evidence somewhat conclusive,. a verdict for the amount of commission now sought to be recovered ] was given—namely, £1 18s. • : .
