MAGISTRATE DISMISSES TRAFFIC CASE
Before Mr W. A. Harlow, S.M., on Thursday, January 26, a charge brought by the Transport Department against Norman A. Redwood, of Taupo, of failing to give way at an intersection to a vehicle on his right. was dismissed. Traffic Officer R. A. S. Miller appeared for the Department, and Mr Corry for the defendant, who pleaded not guilty. For the prosecution, Mr Miller stated in evidence that at 6.10 p.m. on November 10, when patrolling, he saw two cars at the intersection of Kaimanawa and Heuheu Streets which had obviously been in collision. Defendant had been driving a Bedford truck east along Heuheu Street, and the other car, a Vauxhall, driven by Mr L. G. Wooster, was travellmg north up Kaimanawa Street. With the aid of defendant he took measurements and made a plan. Marks on the road showed that Wooster's car had skidded. Visibility to the right was ample. To Mr Corry, who said that the driver o,f the other car had travelled from Waipukurau, witness said he would agree that the driver would be tired. For Mr Redwood, Mr Corry submitted that no prima facie case had been established. Mr Harlow, ,S.M.; held that the oharge had not been established by the evidence. The defendant's truck might have been on the intersection first. The charge would be dismissed.
