Plaintiff said the If-inch account was correct. ; . , J. .West; carpenter, being sworn stated that he went to Mr Lavery’s to get timber for Mr Wood; he said there was no first-class hut considered all as second-class, which was worth Us per 100 feet. • , In answer to the defendant he said the timber varied in thickness, and he would call it second class ; the timber was suitable for the purpose it was used for but not for buildings. Defendant (sworn): Said that plaintiff agreed to supply timber for 93 per lQoft.,.and he was charged 12s and 15s per 100, and he' did. hot like it, and refused to pay tho amount. Judgment was .given for the amount paid into court, £6 7s, and costs of court 19s. i v . J. Wood rR. L. Wood; claim £3 lls 3d. Judgment by default with costs.
