Devore appeared on behalf of the accused; Sergeant Gamble asked that the charge might be withdrawn. He put in a letter received by Inspector Hickson from the chief constable’s office, Nottingham, [stating that’ every possible inquiry had been made, but no evidence could bo obtained substantiating the confession made by Evison. The Nottingham authorities believe the mail’s statement to b 9 untrue. Mr Devore said -that a few friends of accused who had interested themselves on his behalf, had ascertained that in September last, and since that date, the accused had been suffering from a severe attack of influenza. For the greater part of that time he was not accountable for what he did, and at the time of his confession was suffering from a delusion. Inquiries made at Nottingham proved that the spot spoken of by the accused did not exist. The accused was now in his right mind.
