MONDAY, JUNE 23rd, 1890. [before JI. W. Northcroft, Esq,, R.M ] Police y. Wqr. McKenna, Defendant being the holder of a publican’s license in respect qf premises situated at Owlmrou, aqd known as the Hotel, was cqargecj with suffering an unlawful game of the kjnd commonly known as a sweepstake, to be carried on on his licensed premises on 10th M;;y last. Sami, Farmer and Chas. Mark gave evidence for the prosecution. Mr Miller, solicitor for the defendant, raised the point that the evidence did nut prove that the game complained of was a sweepstake, but a lottery. His Worship reserved his decision on the point till next Court day.

Police v. Win. McKenna. Id this case defendant was charged that be did on the 10th May last, at Owharoa, dispose of a gelding to A. Mark and other persons by means of a game of chance, viz., by the throwing or casting of dice. Sam). Farmer and C. Tathill guve qvjdence.

Plaintiff, Chas. Chappell, and John Quinlivan gave evidence on behalf of plaintiff, and T. H. Russell and several others for the defence.

The contention was respecting tho quantity of stone plaintiff quarried while in the Co.’s employ. It was eventually decided to adjourn the further hearing of the case to the Thames, there to take the evidence of G. Ginn, bricklayer, who had been in the Co.’s employ at the time the work was done.
