THE APPEAL COURT.
AN AUCKLAND CASE. Wellington, May 7. Argument in the case in which a summons was issued by Mr Justice Conolly on |the Bth February, 1890, calling on the District Land Registrar at Auckland to substantiate and uphold the ground of his refusal to register a mortgage dated 14th May, 1889, from the Kaihu Valley Railway Company (limited) to John Owen,was taken in the Appeal Court this morning. Judges Williams, Denniston and Conolly were on the Bench. Mr Theo. Cooper appeared for Owen, and Messrs H. D. Bell and Tripp for Registrar. Argument in the case was very short, and only lasted about three-quarters of an hour. After Mr Cooper had opened and stated his case, Mr Bell, who appeared on the other side, said he was nob able to support the action of the Registrar. His Honor then delivered judgment, holding that it was nob the duty of the District Land Registrar to inquire whether the mortgage presented by the Company was within its powers. If it was in proper form, and appeared duly executed, he was bound to execute it. Costs were awarded to the mortgagees on the highest scale.
