Town Board.
The ordinary' monthly' meeting of tho Te Aroha Town Board was held at the Palace Hotel on Saturday evenirg. Present: Messrs Edw. Gallagher (chairman), Lipsey, lleathcote, Harris, Mills. Mr C. Aider, the Clerk, was also present. The minutes of the previous monthly meeting having been read, Mr Harris said he wished to make a remark with respect thereto before they were confirmed. Chairman to Mr Harr’s . You can t make a remark on the minutes (!) Mr Harris : Well, Sir, in the record of the last meeting as just read there is no mention of the resolution moved by yourself at that meeting that the Board go into Committee in order to discuss the uuisanee question. You will no doubt remember yourself and Mr Mills voted in favour of your motion, against it Messrs Lipsey, Heatbcote, and myself. Section 30 of The Town Districts Act, 1881, Clause 15, says “ The Clerk sha'l keep the minutes of proceedings of tho Board in a book, in which be shall enler the names of the Commissioners voting on each question on which there is a division, and every resolution, order, or other proceeding of the Board, etc." Neither the resolution, or those who voted on it, is recorded, and I request that this addition be now made before the minutes .ire confirmed. Chairman to Clerk ; Is that not on the minutes. Clerk : No Sir it’s not, and it never lias been done Mr Chairman. Mr Harris : Well, there can be no doubt it should bo lecorded. The Clerk baying made the alteration the minutes were then confirmed. Correspondence : None, Treasurer • Mr Harris .asked the Chairman who was the Treasurer to the Board. Chairman : Mr AhierAji- /'
Nuisance aud Inspect#' of Nuisances : Mr Harris askeAsrvhad ' ; the Inspector of Nuisances made any report with respect to nuisances known to exist. In several places in tiie township the sanitary condition of things at the present thiie was very bad and required the immeattention of'the Board. If typhoid fever, broke out, throng!) neglect to use proper preventivemeasures, it would do tho place much harm, both as regards tiie present and for years to come. In bis opinion the Inspector of Nuisances was drawing salary as an Inspector, but doing very little work of value as regards reporting or suppressing existing nuisances. Clerk : No report has been sent in by the Inspector of Nuisances ; but he bad seen him, and bo told him (the Clerk) that be had inspected several places where be thought it probable there might be a nuisance but found nothing to complain of.
Mr Lipsey : I certainly think the Inspector of Nuisances might take the trouble to walk to the meeting of the Board anyhow ; so that we could a>,k him any questions, and I would suggest that he be requested to be in. attendance at the meetings in future. Notice of Motion ; Mr Harris, in accordance with notice he had sent to each member of the Board on March Ist, now moved ; That the resolution passed by the Board on December Bth, 1888, appointing Mr Charles Ahier’s house as the office of the Board, etc., be rescinded. Mr Mills asked was the notice of this motion sent through the Clerk. The Chairman said it was not as far as lie knew. Clerk ; I know nothing of it. Mr Harris *o Chairman : Will you be good enough to point out to me where it is laid down by tho Act that a notice of motion to rescind a resolution must be bent through the Clerk, as i certainly am under the impression my notice, having been given seven days before this meeting to each member of the Board, is in order. Chairman : Your motion cannot be pro ceeded with because sub section 13 of section 30 of The Town Districts Act, 1881, suy-8 “ Every notice of a meeting shall bo in writing under the band of the Clerk, and sent to each Commissioner seven clear day's at tiie least before such meeting, and in the case cf tlitf proposal to alter or revoke a resolution the notice shall set forth the business, etc.” That not having been done your notice cannot go on. Mr Harris : Well I am only a new mem-
ber of the Board and not so well posted in the Acts perhaps as yourself Mr Chairman ; for which reason I cannot just at the moment lay my finger on the clause I want, but I know when I looked the matter up at the time I sent the notice to each member of the Board I did so in accordance with the Act. Chairman : Well if you can’t show me the law for doing so we cannot go on with the motion. The Chairman decided against Mr Harris’ motion being proceeded with, on the ground that no'ice had not been given through the Clerk,and asked if that was not dona how could the notice be entered ini the minute book. Clerk ; In the Notice of Motion book yoir mean, Mr Chairman. " , Mr Mills safd he had a notice of motion which he wohld now give,, viz,, That at the next nibhtlily meeting of the Board, to be held on April st!i, ho would move : that the latter part of the resolution, passed oh December Bih, 1888, appointing Mr Aider’s, house tho office of the Board be rescinded, aqd that the office of the Boatd be re-
moved tp the office at Mr Gallagher’s stables.
AJr Jl°tt pointed out that the Board were in the habit of holding their monthly meetings on the second Saturday of the month, not qn the first Saturday, which would be Aprjl sth ; \yiiereupon Mr Mills altered the datp of his notice of motion to April 12th. - v Mr Harris gave notice that at the next
ordinary monthly meeting of the Board he would move that the resolution passed on 29th Sipti'inber, 1888, njrpointing the second Saturday in the month as the nieht of meeting of the Board he rescinded, and that the Board meet in future on the second Tuesday in each month. Financial : The Clerk stated the Boa-d had a balance in hand of £5 5s 7d. Accounts: Several accounts had been sent in which the Chairman said would have to be held over, not having been certified to by the Engineer. The following accounts were passed for payment : H. Crump, for services as Returning Officer at the recent election—extraordinary vacancy—£l Is;Public Ifall Company, for use of Hall for election purposes, ss. This was all the business and the Board rose.
