PIAKO COUNTY COUNCIL Special Meeting.

A special meeting of the above Council was held at the County office, Cambridge, on Saturday last. Present: CrsChepmell (Chairman), Hunt, Horrell, Hanmen Williams, Heany, Brunskill, and Murphy. The fiist business was the raising 1 of Patetero special rate (for repayment of loan of^£l6so, borrowed for formation of Lichiield-Te Aroha road) on the motion of Cr Heany, seconded by tho Chairman, from l-12th to 1-lOth of a Id in the £ ; this being necessary on account of the reduced valuation of this Riding by the last Pioperty Tax Assessment. The next business was the passing of a special order, on tho motion ofjCr Heany, soconded by Cr Horrell, making a By-Law, with respect to traffic engines whilst on roads within the County, in accordance with the resolution already approved by the Council; said By-Law to come into force on December Ist prox.

ORDINAUY MEETING. The ordinary meeting of the Council commenced at 11.15 a.m., the same membeiH being present. The minutes of the previous monthly meeting were read and confirmed. Correspondence : Comes* Slaughterhouse, Te Aroha : At the last meeting of the Council it was rosolved that A, Cornea' application for a slaughter-house license be granted. The license, however, had not beim issued, the Chairman {-tilting that he happened to hear the slaughter-house was closh to a public road, and he therefore instructed the Clerk to make enquiries, In reply to a telegram sent him, Sergeant Eniorson reported the slaughter-house was only 2£ chains from the road. Cr Murphy said the work required to be done, and would ease tho traffic on part of tho main road. Cr Williams : What position is that portion of the district in with respect to being formed into a Borough ? I under* Ptood some document had been forwarded to Government praying that a Borough be constituted. Cr Murphy : Only a petition — that's nothing (!) Chairman : Only £85 10a is available for expenditure on works in Te Aroha Hiding, iiport from the main road Resolved, that consideration of the application bn deferred till next meeting. Flood Water : From Chas. Jenkins, Waioronpromai, complaining that his land, section 7, was much injured by the quantity of water running over it, which had been much increased in consequence of recent drainage works carried out in Waiorongomai township, and requesting Council to assist him in the matter of remedying the evil. In reply to Hie Chairman the Engineer said tho water complained of was following its natural course, but went more quickly now, on aooouut of the drainage works refeired to. Resolved that the letter be received, • From Win, Thomson, owner of Section 109, Block 11. Aroha Survey Distiict, requesting Council to deepen and clean the road drain fronting his section, so as to give him an outfall fur draining hi* land , Cr Hanmer remarked tho work referred to much needed to be done, as the roid was being greatly injured b) tho water lodging. The Engineei also recommended that tho work be done, as it was impossible to keep the road in #ood order until it was ; and said he thought the best fall would be towards the Government railway drain. Resolved, That the Engineer bj instructed to take levels and report on the matter to the Chairman, who could theu apply to Government, if downed desirable with a view of getting a culvert put in. Road to Okoroiro Hot Springs; From F. D. Rich, General Manager of the Thames Valley Lund Company, Limited, dated Auckland, August 31st, stating that he was surpri-eil to see by the lepoit of the proceedings at the last meeting oE the County Council that Cr Williams had pro. mised a contiiluition of £60 1r 'in the Thames Valley Land Company, lowurds cost of the pioposed road frouiOkoroireJTlug' Station to the, Te AroliA-Tiiunfiuld road, and desiring to itft'oriueJJonnoil that this promise was made by Mr Williams owing to his having misinterpreted his (Air Rich's) letter to him. Also, fnither stating that ho had requested Mr Williams to do his beat to have the proposed road constructed out of the County funds, and that if such was done, in addition to the £200 promised by Mr Isa.ics, he would give a contribution of £.00, but this promise wait never intended to apply if tho money was raised by a separate rate, which would mean to the Company ho represented paying down £260 cash, or by a, special rute for repiyment of a loan. Cr Williams said Mr Bich was quite ri^ht, aB he found on reading over his (Mr Riohs*) letter again, alter the last Council meeting. [Mr IsatJCR here remarked he wished the Council to distinctly understand li 9 was prepared to pay down the L2OO he had promised towards the cost of constructing the proposed road any day ho was called upon to do so.] On the recommendation of Cr Heany the date of holding the public meeting of ratepayers in Patetere Riding (re lonn proposed to be raised for constructing said road), was fixed for Wednesday, Soptem ber 25th, at Camerons ntore, Oxford, at 8 p.m., the poll to be taken at the same place on October 9th. Thompson's Track : From Minister of Mines, in reply to Council's letter urging upon Government the advisability of giving a further grant towards the construction of Thompson's Track, so that it might be made available for wheel traffic ; stating that whilst Government recognised that the proposed work would be a public con* venience, there were no funds available for the purpose. Main Road, Taotaoroa : From the Taotaoroa Road Board, requesting Council to have the main roads within Taotaoroa Riding" gravelled during the ensuing summer. Letter received. M?in Roads Maintenance : Resolved, on the motion of Or Brunskill, seconded by Cr Williams : That the members constituting the present btanding Finance Com* mitte (viz., Chairman, Crs Horrell, and the mover), be appointed a Committee to take into consideration the best means for the future maintenance of all main County roads ; the Committee to, prepare a report to be laid before the no^t meeting of Council. (Cr Murphy moved : That Cr Hanraer's name be added, but Cr Hanmer declined). Recent Horse Accident at Diamond Gully, Waiorongomai : With respect to a claim for £ value of a pack horse killed by falling over Diamond Gully, and loss of meat, etc., sent in by Messrs Roberts and Littlejohn, butchers of Waio* rongomai, considered at the previous meeting uf Council, the "Engineer leported as follows : — With reference to the accident at Diamond Gully J have- heard the following particulars :— Mr Roberts' man, Plato by name, wis riding one horse with a pack horse following him (pot led), and that home one coming on behind the last horse startled it, and it rap forward and tried to pass Plato at the narrowest place on the track, and as there was not room for both horses and packs, the horse trying to pttbfa (fortunately on the lower side) waa j

Of course you will know whether a horse following another (and not led), i^ under the control necessary to establish ti legal claim for damages, A similar case was disposed of at Gisborne some two years ago, and the plaintiff was non-suited. Chairman « In the face of that report it appearst^me that, even if the Council were liable for accidents ooouring through goldflelds tracks being out of repair, they would not he liable in this instance Resolved, on the motion of the Chairman, , seponded by-.Cr Murphy: ThatMessi's Roberts and L.ittlejohri be informed the Council do not recognise any liability in the matter. Forfeited Deposit ,From Win. Roycroft, I Waiorongomai, whose tender was accepted Rome two or three- months. back for filling in the approaches to the Walhou bridge at Waiorongomai Landing, stating that he had worked for nearly three } weeks, removing in that time some 200 yards of earth ; also cutting and carting several hundred fascines before he was compelled to abandon the oontract owing to wet weather, etc., and requesting Council to refund hie forfeited deposit of L 2. The Chairman said he felt sorry for the man losing so much work, but he should remember that it was the next lowest tenderer (Orr, L'4s), who had taken up the contract, was the one who had derived the benefit of the work done, and not the Council, who had to pay some L8 more than the first contract price for the work. Letter received. Tenders : The following tenders were received for building a new bridge over the Waitoa river, Thames- Waikato main road j C. H. A. Tonge (sureties, A. Downes and E. Gallagher), L 217 lOs ; W. OBrien (W. Dibsell and P. Dillon), LI9I ; J, West (P. Baine and J. Comes), LlB9 ; J. B. Ueathcote (J. Hart and M. Hotchin), L 179 ; O'Connor and Devey (J. Wiseman and A, Comes), L 165 ; J. Lavery (W, Hethrington and R. Cannell), £162. Resolved that Mr Lavery's tender be aocepted, provided that he agrees to substitute totara piles instead of heart of kauri as provided in specifications). General County Rate Levied : A general late of £d in the £ on all ratable property in the Ridings of Waitoa, Watamata, Patetere, and Taotoaroa, and of f d in the £ over Te Aroha Riding, was levied. Road Repairs : Cr Hunt was authorised to have a portion of road, near Murray's, put in repair ; estimated cost L 5 ; and Cr Brunskill some repairs on the Cam-bridge-Tauranga road, near the boundary gate, estimated cost about £2. Proposed Road toOkoroire Hot Springs: Mr Sandeß (in accordance with instructions he received at the previous meeting of Council), reported on probable total cost of making proposed road, and fencing sump, which he estimated at LBlO ; which with Engineer's commission, etc., Council considered would mean L9OO or LlOOO. Oxford-Mntarnata Road : Plans were produced showing the portions of the road it was desired by the Auckland Agrioul tuntl Company and other property owners to have closed, and the proposed line of road to be taken in lieu thereof. Mr Bailey, on behalf of the Auckland Agricultural Company, and Mr Hume, were present, and promised to bear all cost in connection with making the proposed alterations.
