PUBLIC WORKS ACT. PROPOSED AMENDMENTS. INTERESTING TO LOCAL BODIES. Wellington, August 28.
Last session the Government introduced a Bill to amend fche Public Works Act, bubifc did not meet with much favour from the House and had speedy despatch. Another Bill has been bi-ought in this session, being last year's Bill considerably modified, and this has had a rather warm reception. It was read a second time yesterday after considerable discussion. Mr Mitchelson, in moving the second reading, said that copies of the Bill had been sent to all the local bodies of the colony during the recess. Very few amendments were proposed by these bodies, but what suggestions had been made had been embodied in the present Bill. The Bill provides very stringent measures for compensation claimants, and a claimant is not allowed to recover for matters not particularised in the claim. The Governor may declare any portion of land taken for railway purposes to be a public road or street and vest the same in a local authority, the latter being allowed to object if they like, but not to refuse. The liability of the local authority over roads, etc, is to continue, notwithstanding the alteration, etc., in the road. A clause provides for an owner of property removing gorse from roads abutting on his property. Proclamations for taking land for Public Works may be cancelled for error or ( misdescription. Xi a .local authority wishes to construct a bridge, or to establish a ferry or fordjthat will benefit an adjoining district, the Governor may in certain cases compel the local authority of such adjoining district to contribute to the cost of same. There are many more clauses relating to compensation claims, machinery of the Act, e.tc. o .Considerable opposition was shown to the claupe relating to the vesting of roads in local authorities without their consent, and indication was made that several amendments would be attempted in Committee.
