In reply to your qnest.on I may state that, to the best of my recollection when the question of repairing.the Te Aroha-.Wnio-rongomai road came before the Council, it was stated by one of the members, that the road was in a dangerous state, having been cut up by the extra traffic put upon * it by the Te Aroha S. and G. M. Company., ahit Ihat if the Council did not immediately set to work to put it in, order, some accident would be sure to. happen, and the Council would be muloiad in damages in ;consequence. As it seemed to me that there was something in the manner or tone in which this wak said, which looked like an attempt to intimidate the Council into doing the • work, and as I did not choose to. let it, be thought that the Council was to be frightened into it, I pointed out that under the &2nd section of '* The Public Works Act, 1882," the Council coul*~ recover from the person by whose orderany undue weight or extraordinary trafficis put upon any road, the amoant of expenses incurred by reason of the damage arising from such weight or traffic ; bat the idea of tak ; ug action, under that section was nevet seriously* contemplated by the Coonoil. %t I remember rightly there were eight members* present $ and if such a proposal* bad been put to the Council, ! think that even Crs Mills and Murphy could hardlyhave oat-voted the othjer six "ananw maus " members, I am, etc., WIH.IAH P.
