Mr MoVoagh said the case hail been adjourned the last Court day at the request of Sii Wm., although lie knew no leason why it was not then proceeded with, as plaintiff, defendant, and also the witnesses were all present on last Court day. Sir Win. Wasteneye : Your Worship did not rule the li>st Court day that the coats of adjournment must be paid before the case was heard. My client has no money jnat now ahont him, but is expecting to receive money on the 23rd of this month. His Worship You surely know that it is a rule of all Courts that when a case is adjourned for the convenience of one paity they must pay the costs of adjournment before the healing is proceeded with. If if were not so a man could go on for an indefinite period, saying he was not ready to go on with the case, and asking for adjournments, and put the othtr side to no end of trouble. His Worship adjourned the Court for a quarter of an hour to give plaintiff time to try and procure the money ; this, however, he did not succeed iv doing ; and on the case being again called ISir Wm, Wasteneya said he supposed His Worship would non-suit him. His Worship ; If I were to give a non-suit it would imply the case had been heard, or partly so, which is not the case. Your best plan is to withdraw the claim. Sir Wm. Wasteneys : Then I ask your Worship's permission to withdraw the case. Granted, costs being allowed dafenlant as follows :—4: — 4 wit nesses from Tui at Bs, and 3s mileage each, £2 4s ; subpoenas, 12s ; Solicitor, £1 Is ; Total £3 17s 6d. '
