WARDEN'S COURT, THAMES. THURSDAY, NOV. 22nd, 1888.
(Before BT. W. Northcroffc, Esq., Warden.) Application granted : — J. G- Vivian, Lucky Hit licensed holding. The following applications were adjourned until 6th December : — Murdoch Ross, Perseverance ; R. Trotter, Robert Burns, F. Challis, Maripoga Extended ; Mr.ta G. M. Co., Mata G. mid S. M. Co., R. McDonald Scott, Adeline Amalgamated ; G. J. Panter, Centennial ; E. 0. Corncs, residence site ; G. Walker, water -race and machine site ; J. C. Williams, water race ; and Alex. Bruco, Una claim. Protection was granted to H, Rogers for the Welcome Guesfc claim at Tapu, for four months ; and R. Lawno, to work the Adair, olaim, Upper Tararu, for three n onfchs, with two men, and thq Little. Beauty claim, for a similar period, with one man. At a recent sitting of the Warden's Court & plaint was heard, Win. Laurie v. Emily Richards, regarding a disputed share in the Ostrich claim at Waiomo, Mid in which Mr Northcroft reserved judgment until to-day. In giving his decision this morning tho Warden said he had gone carefully through the evidence, and he had come to the conclusion that he would not bo doing right if he compelled Mrs Richards to transfer- the share to Laurie. He was of opinion that the share had been obtained from her in consequence of false representations, which amounted to fraud, and this was supported even by the evidence of complainant, who, in the course of his crossexamination at the hands of Mr Lusb, had stated that ho had told her 'ie owned a. share'and he knew of a person who would purchase two at £5 each, but who would I'iot take one by itself. He therefore led hereto believe that he w.as buying for someone else, whereas sunh was not the case, and the share was then worth much more money. Complainant had not bought the shnvo fora principal, and ho now asked that it should be transferred to himself. He had used a fraudulent device to get the share from defendant, and she should not be made to transfer it". He w>uld older, however, that the £5 cash she hnd received should be at once paid over to complainant. Mr Stewart, who appeared for complainant, in the absence of Mr Lnsli, applied for costs, but the Warden declined to accede to the, inquest. {Sulwqu'oritly the £b was paid over by Mrs Richards to complainant. — -Thames Star.
Notice is given by advertisement that a number of licensed Holdings (principally «t Marotolo) have been declared forfeited by the \V u rden, and that the land may be applied for on Junu;iry 16th, 188 Q, for gold miding purposes.
