RESIDENT MAGISTRATES COURT, TE AROHA. TUESDAY, NOVEMBER 6, 1888.
(Before H. W. Northoroft. Esq., R,.M) W. H. Sangwin v. Smith and Don, claim, 16s. The plaintiff had been a waiter in the service of the defendants, and sued for 16s, amount of train fare from Auckland, which plaintiff contended had been wrongfully detained. Plaintiff was nonsuited. Tohatoha v. N. Baskett. This was a claim of £3 10s, for the illegal detention of a horse for four days. The defendant said the horse was taken by mistake, and it was only detained for a few houis. Chas. Baskett, a son of the defendant, described the circumstances under which he took the horse. The animal they had been looking 1 for had been turned out during the winter, and plaintiff's horse was taken in mistake for this one. His Worship said iio man had a right to ride anyone else's horse, and when he found the horse did not belong to him, he should have told his son to dismount, and not allow him to ride on. He would impose a fine of £2 7s 6d, and 3s costs. There was a cross action arising out of this case, a claim by Baskett against the natives for a saddle and bridle detained by them. His Worship ordered defendants to restore the saddle and bridle to plaintiff and to pay £1 costs.
