INTERESTING MINING CASE,
Thames, June 23. A cask possessing some interest to those connected with mining came on for hearing at the Warden's Court yesterday afternoon, being the fh&t for the forfeiture of a claim that has been heard at the Thames under the Mining Act of 1886. Under the old Act, only the Mining Inspector could institute proceedings and have licenses forfeited for non- working, but under the pic-ent Act anyone can do so, though in each case the result is the same, viz., that the mound, if forfeited, must be sold by auction by the Wai den. The application in question was that W. 8, McCorraick, who* asked that t l ie Consols licensed holding, situated in the Hape Creek, and belonging to J. H. Withctord, should be foifeited upun the following grounds :—" That the grantee has not complied with the condition^ upon which the license was issued ; that he has done no v. ovk, or very little, on the said holding ; that he does not intend to woik the same, and holds it for speculative puipo&cs only." Mr Button, of Messrs Whitaker and Unwell, being unable to appear for Mr Wiihefoid, owing to being engaged at the bupiemo Court, Mr Witheford conducted his own ca.se, which is the iiist heard under the new Act. The Warden allowed Mr \\ itheford to jotain the mine, with a fine of £10 for the ground not being fully manned.
