WARDENS; COURT, THAMES MONDAY, OCT. 24th, 1887. PROSPECTORS LICENSED HO LDING MARITOTO, GRANTED.

A Sitting of the Warden's Court was held at noon to-day before H. A. Stratford, Esq., Warden, when the^ adjourned application of Mr Richard Mcßrinn, the well, known prospector of Hikutnia, for a licensed holding of 30 acre? at Maritoto, was dealt with. Mr Miller appeared for the applicat. In the course of his remarks the Warden said that in a case recently hard before th& Coutt, Mr Button, of Auckland, expresseci regret that however the law might be on*, the subject, it was a.n. injustice that per-* sons should be allowed to mark out much larger areas of ground than they were entitled to by the Act, and that the excess should be protected by the Crown until the granting of the application, as the earplw* ground could thus not be taken, up by others «nd worked. He (the Warden) would like to point that it was not contemplated by the Act that there should b« delay, and he might mention that in aortm districts o,ver wlijch he h,ad had control*

eurveyor raided in the same buildmg, who at ,-once proceeded {with the survey, thus obviating any unnecessary delny in the granting of the applicetion. Sometime* delay* were not necessary, and in t«ucn case, the Warden could cither refuse to grant the license applied for or reduce the area d«ir«d. He had already proTiiised to jtrant Mr Mcßriun a licensed holding of 30 acres, and would novr do so. H« could not believe, however, that a prospector of Mr Mcttrinn's experience did not know that the ground he hud pegged out contained much more than 30 acre*, as i» comprised about 60. He now made thene remark! in order to let those people know who acted a« Mr Mcßrinn had done, that the Warden oould refuse their application* when they were guilty of such conduct, notwithstanding all the expenses they might have been pat to But after taking thewhoWof the drcmnatances into consideration, in connection * ith Mcßrinn # application, he (the Wai den) would now declare it to be granted. The other applications for ft water-race and machine site had not yet bttn advertised and the formalities c<Wlift<J with, nnd would conse quently ba U journed until the 10 h Nov-eniher-At the lequo^t of Mr Miller, the dPPIi-Miiou f«ir * spcci.il claim wns then withdrawn, and the proceeding tertnmitLed — Thumed Stai.
