THE COUNTY TRAMWAY.

Now that it is proposed by the Fialco County Council to lease the Waiorongomui Tramway, we reprint for the information of our readers the conditions under which it was granted the County Council by the late Warden Kenrick, and which were published in our issue of June 28th, 1884 :— 1 . A reserve of one chain in width is granted; measuring three quarters of a I chain from the centre of the tramway on | the upper side, and a quarter of a chain I on the lower side, except on the self-acting inclines, where the reseve shall be one h 'If ' chain from the centre on either aide of the tramway. 2. Owners of mines to have the privilege of erecting hoppers or shoots and constructing branch lines, for the purpose of sending quartz to tramway, of carrying any lines, or shoots, or ciossings, (the latter on trainWas level) or tunnel under the tramway oi within the said reserve. The right so exercised not to interfere with the working of the tramway, or with each portion of the reserve as may be required for tramway purposes-. Security to be given in advance that in case of any such interference causing damage 1 ta the 1 tramway or loss to the proprietors compensation s-'iall be paid 1 , and the amount of such damage or loss shall be assessed by th< | Wniden, and the amount of such assessment

shall be paid to the proprietors within seven days of the making of such assessment. 3. The light to the tramway not to bo transferred without the written consent of: the Warden first obtained. 4. The tramway fo be available to the public for transmitting quartz from any mine on the field to any battery now or her lafter to be erected, and for transmitting any mining requisites, stores, or other mitenals. 5. The Piako County Council to hnve the right, from time to time^ to fix a scale of charges for" such conveyance, such charges not to exceed 4s 6d per truck for conveyance of quarta, truck to bs not less than 32 cubic feet, water measurement (except in case such charge dots not cover the full necessary expense oL* working the tramway, when" the rae to bo charged shall be the actual cost of conveying quartz over tha tramway). For goods or mining requisites, for one cwt., or any poition of one cwt., the charge not to exceed Is per cwt up to 5 cwt, beyond that weight by arrangement. 6. Owners of mines who have constructed or who may hereafter construct branch tramways connecting their mines with the tramway, or soire battery, to have the right to use such portion of any onehorse grade on the Cotnty tramway a<? they may require for their own u<?e, finding their own trucks and labour, on payment of a royalty not to exceed le per truck, and if any self-acting incline be required special arrangements to be made with the proprietors, such right to be exercised so as not to interfere with the working of the tramway by the proprietors, and in ca^e damage or loss of time shall be caused by the said parties bo using any horse grade or incline, such damage or loss of time shall bo assessed by the Warden, and the amount of s-irh assessment shall ba paid to the proprietorwithin seven clear days of the making ol such assesment. 7. Such portions of the tramway ressi ye as are not m the actual occupation of tho proprietors to bo open for mining purpose 5 , compensation for actual disturbances or injury to be pr.i 1 to the proprietors on assessment by the Wai den, within sever. days thereafter. 8. Machinery for mining purposes up to the capabilities of the line to be carried on the line when required, at a charge to be agreed upon between the owners and proprietors of tramway. Should no agreement be arrived at, the charge to be fixed by arbitration, each party choosing an ai bitrator. The arbitrators to nominate an uncpire, whose decision would be final and binding on both parties. 9. All the disputes between the proprietors and persons using the line to be settled by aibitration or by the Warden, at the option of the paities.
