CHARGES OF FRAUD.
(y_ IN PROPERTY TRANSACTION. NEW TRIAL REFUSED. CHRISTCHURCH, Nov. 18. Mr. Justice Herdman dismissed a motion for a new trial in the case of Peter Dewar Boag, of Christchurch, ami Arthur Daniel Kennedy, of Wei-, liugton. Charges of fraud were made on both sides in respect to a sale of Mount Whitnow, Canterbury,»±Tom defendant to plaintiff, and the sale of Pareata property at- Auckland from plaintiff to defendant. The jury decided that defendant had been guilty of fraud, and that plaintiff had not, and awarded plaintiff (Boag) £1535 10s damages. Defendant applied for a new trial on the grounds that the verdict was against the weight of evidence and the damages excessive. His Honour said the jury had not been guilty of any unreasonableness thrt would warrant his interference.
