The circumstances were that both defendants enlisted and went to Trentham Camp, where however they were discharged for being medically unfit; On 6th April Staff Sergt.-Major Tuc'key wrote to tue defendants ,who had not been attendnig territorial parades and pointed out that the fact that they had been discharged from Trenham did not relieve them cf attending territorial parades. They, however, did not attend parades after receiving the letters . Each defendant was convicted and fined 30/-. A charge against C. Egar for failing to attend parades was adjourned to allow of defendant being examined in regard to his physical fitness. \ A case against A. Bagley was called ,the charge being one of obstructing a parade. Sergt.-Major Tuckey stated that the defendant had arrived on parade late and so had caused an obstruction. »
The presiding magistrate, Mr. J. G. L. Hewitt, stated that he did not interprete the act in that way and mus dismiss the case. He thought, however, that in similar cases, a charge of failing to attend parades could be taken against the offender. If a man was not on parade when the fall-in was sounded he must be absent.
