JILTED, GETS BACK MONEY.
BARGAIN MAJM3 BY YOUNG MAN. AMAZEMENT IN ENGLISH COUET! A-bargain of a kind which is'said to be faitly 'frequent in England, was described in tho Westminster County Court recently. Tho judge expressed amazement, ' and, incidentally, expressed his opinion about a young woman who had broken off her engagement and had then refused to return the money sent to her by her flnancce with which to start a home. Edward John Clarke, an aecoutant. living at Canonbury, a London suburb, sought to recover from Miss Maud Maylin, residing in Harringay, another suburb. Mr. • Duncan,.-Clarke's counsel, said the plaintiff revisited England on leave from Brazil in 1912. He met the defendant, and became engaged to her. Beforo going baek to Brazil h~ opened a bank account in her name and arranged that in his absence £lO monthly should be forwarded to her out of his salary by tho London office of his employers. The idea was tb?n this money should be banked nnt : l £SOO had accumulated, and that Clarke should then return to London, and tho marriage take place. *
Sums of £lO continued to be forwarded to Miss Maylin monthly, said counsel, in accordance with the arrangement, and, in addition, Clarke gave the . young woman £lO for a holiday and money for the purchase of jewellery. After £IOO had been paid in this way, Clarke lost his employment 3n Brazil, and returned to England. Trouble then arose, counsel said, about j a German who had been paying attention to Miss Maylin, and ultimatciy the engagement was broken off. Clarke demanded the return of the monej- under the marrkicrc arrangement, bur Miss Maylin contended that she bad received it ?s a gift. The plaintiff, under cross-cxamiiia-tion, said he opened the bank account in Miss Mi.yUn's name because he trusted her implicitly. Miss Maylin, i>i her oviednM, sa : d that, being out of t situation, she, drew most of the money oul of the; bank and spent it. Judge Woodfall .s.-.id it was a re- ; markable story for a young woman to stand up in the witness-box and 1 ell. In the course of his experience he hacr never heard of such an arrangement. He decided that the money was placed in Miss Maylin's hands in trust, and he gave judgment for the plaintiff, with costs.
