MOTORIST’S APPEAL FAILS

DAMAGES AWARD UPHELD The appeal of William McArthur, of Auckland, against the decision of Mr. W. R. McKean, S.M., in awarding £6O damages against him as a result of a motor collision, was dismissed by Mr. Justice Herdman, in the Supreme Court yesterday afternoon. As a result of a motor-car collision in Park Road on August 13 last year, Horace Hookham, a bank clerk, now of Wellington, brought an action in the Magistrate’s Court against McArthur, and the former was awarded the full sum claimed. Mr. Hampson represented the appellant and Mr. R. N. Moody the respondent. In dismissing the appeal, his Honour said that if he were to allow it lie would have to jettison the evidence of one of the witnesses. The judge added that he was not prepared to say that the appellant had shown on the evidence that the magistrate could not have come to the conclusion he had done. Costs were allowed against the appellant.
