SLANDER ACTION FAILS
DOCTOR’S CLAIM FOR £I,OOO NURSE’S WORDS PRIVILEGED Press Association WELLINGTON, Today. In the slander action instituted by Dr. R. W. Richards, who claimed £I,OOO from the Australasian Temperance and General Mutual Life Assurance Company, his Honour ruled today that the alleged statement of the nurse was made within the scope of her employment by the. company. He also ruled, however, that the occasion was privileged. It would be a 'monstrous thing if such a nurse, when she said the health of a person was suffering through the neglect of a medical man. could not make such a statement bona fide without rendering herself liable to an action for slander, he said. Another question was whether the fact that the words had been uttered, assuming they were uttered, in the presence of a person having no common interest in the subject matter, destroyed the privilege of the occasion. In his Honour's opinion it did not, provided the nurse was acting bona fide and without malice.
