CYCLIST CLAIMS £650

DAMAGES FOR INJURIES ACCIDENT ON HUTT ROAD Press Association WELLINGTON, Thursday. As a sequel to a collision on the Hutt Road on May 24, between a motor-car and a motor-cycle, Arthur Hirschorn, a salesman, of Upper Hutt, sued Leonard Myvern Wallace, of Wellington, for £650 general and special damages. The case was begun today in the Supreme Court. In his statement of claim the plaintiff alleged that as a result of the defendant’s negligent and unskilful driving of a motor-car be had been thrown from his motor-cycle and seriously injured. The injuries consisted mainly of a fractured wrist, a fractured clavicle. and severe injuries to the head and knee. Plaintiff was an inmate of the Wellington Hospital for more than one month, and be would be required to attend daily for treatment as an out-patient for a further period. He would be unfit for his employment for three months. Evidence was given by plaintiff that just prior to the accident he was pas.sing a car, which was travelling in U;e same direction toward Petone Another car, which witness had previously noticed standing on the left-hand side of the road on the macadam, suddenly swung out in front of him. He realised it was impossible to get through between the two cars, and decided to go over to the right, to avoid a collision. However, his machine struck the second car, and he was thrown heavily to the road. For the defence, it was contended that Wallace did not signal because he had plenty of time to turn across the road before the car in tlie rear came up. Hirschorn suddenly came up behind the other car at a speed which one witness placed at 45 miles an hour The defence contended that the accident was due solely to the excessive speed at which plaintiff was travelling. The case was adjourned.
