When the Mecca Oil Company case was resumed today counsel lor Pimentel said he did not propose to submit any further evidence on defendant’s behalf. Ho closed his case, defendant accordingly not going into the witness box. * Mr. Treadwell for the plaintiffs said he wished to draw "the court’s attention to the significance of the fact that defendant had not gone into the box. Counsel for defendant: I wish to object most strongly to that. Mr. Treadwell said this sudden conclusion had come as a great surprise to him. Only a few moments before tho court opened he had it from defendant himself that defendant would be giving evidence. Mr. E. Page, S.M., said he would deliver a written judgment within a few days.
