DISPUTE OVER PAYKEL BUILDINGS ACTION INVOLVES £SBB Claiming: £SSB for professional services in reporting upon the construction of the Paykel buildings and giving technical details in connection with litigation then pending, Edmund Rupert Morton, an Auckland architect. sued Max Paykel Buildings, Ltdin the Supreme Court today. Morton claimed that in January, 1928, Max Paykel, managing director, had engaged him to examine and report on the condition of building, any defects in design and the construction generally, at a fee of £IOO, which was arranged verbally. The defendant then comenced an action against its architect, alleging negligence and required plaintiff to prepare the techni-

cal aspects of its case. TTe claimed that his fee of £663 was quite reasonable for the work he had done. The sum of £175 had been paid in respect ot the company's indebtedness. The defence contended that the ♦ barges made by the plaintiff were excessive.

Mr. Finlay appeared for the plain tiff and Mr. Northcroft for the de fendant.
