DEATH CAUSES DIFFICULTY

Press Association WELLINGTON, Today. With the death in California of Sir Maui Pomare, an unusual position has arisen, for which no provision is made in the Electoral Act. It is laid down that the registration of the death of any member of Parliament shall be reported within 12 hours to the Speaker of the House of Representatives; but there is no legal provision for the initial steps to fill a vacancy caused by a member dying outside New Zealand. The death of Sir Maui provides a case that is almost without precedent in New Zealand, for only one member of Parliament has died in similar circumstances. It is not likely that a by-election to fill the vacancy caused by Sir Maui’s death will take place for some considerable time. If the body is to be returned to New Zealand it can be assumed that no action will be taken until then; but should burial take place abroad the difficulty will have to be surmounted by accepting notification of death from some responsible authority in California.
