Is a wife who is a passenger in her husband s motor and who is injured as the result of her husband’s- negligence entitled to recover damages from the third party who is guilty of contributory negligence? According to Mr. E. Page, S.M., she is. A claim was made by Mrs. J. A. Rudge against H. N. Fearnley arising out of a collision on a bridge near Pahautanui. The magistrate held that both drivers were negligent. He awarded plaintiff £25 with costs amounting to £9 3s.
