The Full Court having determined i that it was not necessary to decide i ! for the meantime the question of ; jurisdiction argued before it last | week in the case in re Taare Wai- ! j tara, deceased, proceeded today to; i hear an originating summons brought j ! by Rawdon St. John Beere, the sur- ! viving trustee in estate of Taare Wai-j j tara, late of Parihaka, who died in July, 1910, for interpretation of the \ will of the deceased. The questions submitted by this | summons for the answer of the Court < were: (1) Whether, since the death of i Henry David Bates (half-brother of j the deceased and beneficiary under his will), one-eighth of the income is still J ! to be paid to Pereni Te Whiti, Taare ! I Waitara’s widow. (2) Whether, after the death of the' said Henry David Bates and the children of Wiremu Matangi, another half-brother and beneficiary in the share of the income is still to be paid to Pereni Te Whiti if alive, and to Teoti Te Koea, a grand-nephew of the deceased, if still alive; and as to whether the distribution to the next of kin should be postponed during the lifetime of Pereni Te Whiti and the lifetime of Teoti Te Kaea. (3) As to who are the next of kin, for -whom the estate is to be held after the death of H. D. Bates, and the death of the children of Wiremu Matangi. Counsel for the plaintiff trustee are Mr. H. F. Johnston and Mr. H. V. James, and for the various beneficiaries, Mr. E. P. Bunny, Mr. P. B. Cooke, Mr. L. Wilson, Mr. H. E. Evans and Mr. Barton.
