“MUST TAKE RISKS”

SUBCONTRACTOR OPPOSES DISCHARGE “The creditor is a sub-contractor and must take his risks like other people.” declared Mr. Justice Smith in the Supremo Court today, in granting a discharge from bankruptcy to Ernest Stratford Boyle, a plasterer, of Auckland.- Mr. Purdy appeared to oppose the discharge. Mr. Tong, who supported the motion, said that Boyle, who had gone bankrupt in September, 2 927, had a wife and five children to support. There was no suggestion of anything improper, but the creditor opposing the discharge considered that bankrupt had been in a position to liquidate some portion of the debt. The bankrupt had been more or less in constant work since, but had been embarrassed by having to find work and wages for two apprentices, whom he had engaged when in a partnership business. The debts all arose out of the partnership. His Honour pointed out that the partner claimed £1,500 against the bankrupt’s estate, but Mr. Tong explained that the claimant had been called on to prove his claim but had failed to do so. After Boyle was examined, the judge granted the discharge.
