GOLFER LOSES DAMAGES
CHOCOLATE FIRM WINS APPEAL
OFFENDING ADVERTISEMENT LONDON, Tuesday. The Appeal Court today upheld the appeal of Fry and Sons from the judgment of the King’s Bench awarding Mr. Cyril Tolley £I,OOO damages. The Appeal Court held that, though the Arm’s action in not obtaining Mr. Tolley's consent to the advertisement concerned was inconsistent with the decency of life, it was not defamatory. In the Court of King's Bench on July 15, Mr. Cyril Tolley, amateur golf champion, was awarded £I,OOO damages against Fry and Sons, chocolate manufacturers, for publishing an advertisement in 64 newspapers, which consisted of a limerick and a caricature showing Mr. Tolley driving, with chocolate in his pocket. The plaintiff complained that the advertisement suggested that he was making money out of golf. He was extremely jealous of his amateur status. A stay of execution was granted, on the ground that the damages were excessive.
