DAMAGES CLAIM FAILS Iho claim of a Wliakatane farmer Ernest: Cartier, for £2,000 damages against Bart Tucker, Mho, as second mortgagee of Cartier’s property, seized the stock and the land, which was subsequently sold by the first mortgagee, tho Public flrustee, to defendant, ivas dismissed by Mr. Justice Kennedy in a reserved judgment delivered in the oupreme Court yesterday. His Honour held that by seizing all chattels and stock, which included others than were in tho bill of sale the defendant had acted illegally and lie considered that Cartier was entitled to some compensation for this act. Ho awarded £257 damages under this head, and also £2O damages for trespass for tho seizure of the house Costs as on a £ 1,500 action were awarded to plaintiff.
