CLAIM ABANDONED
WOMAN SUES CAR-DRIVER CHIEF JUSTICE’S COMMENT Press Association WELLINGTON, Today. In the Supreme Court on Thursday Mrs. Gertrude Mary Le Seur claimed £451 10s damages from Leo Chung for injuries received when she was allegedly knocked down in Courtenay Place last June by a motor-car driven by Chung. The Chief Justice, after hearing plaintiff’s evidence, refused defendant’s application l for a non-suit.
The evidence showed that plaintiff and two other women were crossing the road on a dark, wet night and were knocked down by a slow-moving motor-car, which had the automatic light signals in its favour.
Yesterday plaintiff abandoned the case and judgment was given for defendant without costs. The Chief Justice said he thought the course taken wise, as he had grave doubts whether the non-suit applied for should not have been granted, though lie had preferred to leave it to a jury.
