MOTOR COMPANY SUED
ACCIDENT INVOLVING ALLEGED AGENT PLAINTIFF’S CLAIM FAILS Press Association WELLINGTON, Today. A claim was made in the Supreme Court yesterday by George Everson, of Petone, against the Canadian Knight and Whippet Motor Co., of Wellington, for £213 Is 6d special and £BOO general damages as the result of a collision on the Hutt Road on June 22 between a car and plaintiff’s motor-cycle, the allegation being that the driver of the car was a servant or agent of. the defendant company, and was unskilful, unlicensed, and guilty of negligence. The defence was a denial of all the points raised, and plaintiff -was nonsuited. Mr. Justice Macgregor said the main doctrine of the law that an agent could not delegate authority without instructions was quite clear. There was no evidence to show that the driver was a servant or agent of the company, and plaintiff had not proved there was any case to go before a jury. He regretted the result fo.r more than one reason, and especially in view of plaintiff’s injuries.
