ROYALTY ON KAURI GUM
DISPUTE IN THE NORTH JUDGMENT FOR PLAINTIFF Judgment for plaintiff for £125 Us 3d less a sum of £7l 17s 2d already paid into court was given in the Supreme Court this morning by Mr. Justice Herdman in the case in w'hich Hayward Charles Subritzslcy, hotelkeeper, of Mangawai, proceeded against John Joseph Silich, gumdigger, of Dargaville, for royalty on kauri gum. Plaintiff, who claimed £l3l 5s as royalty, £2OO for depreciation in the value of his land, £IOO for loss of royalty on gum left in the ground and £IOO as general damages, said that defendant had agreed to pay a royalty on all cleaned gum taken from his (plaintiff’s) land and that Silich was to sell only through him. Defendant had, however, sold uncleaned gum through his brother, Nicholas Silich, and plaintiff had lost royalty. The judge dismissed the claims for depreciation and for loss of royalty on gum left in the ground. General ..damages amounting to £lO were i allow r ed.
